[筆記] 韓國Mobile Medical App Safety Guidance

這個審查指引中文跟英文都有好幾個寫法,這是我自己的英文翻譯:

在新竹生物醫學園區的網頁則是使用「醫療行動裝置應用程式(Medical Mobile App)審查指引」這個名稱,本文如下:
韓國MFDS已於2013/12/26發布「醫療行動裝置應用程式(Medical Mobile App)審查指引」,未來與健康照護相關的行動裝置應用程式在韓國會被歸類於醫療器材管理,並須符合韓國當地的醫療器材法規。
註: 美國FDA甫於2013/9/25發布「Mobile Medical Applications-Guidance for Industry and Food and Drug Administration Staff」此份關於醫療行動裝置應用程式的審查指引,韓國在國際法規調和與進展方面十分迅速。

[Glossary] Ankle-Brachial Index (ABI)

中文名稱:腳踝-手臂指數

分別測量手臂及下肢之血壓,再以下肢 的收縮壓除以上肢的收縮壓,所得之數 值既為ABI
可簡略測知是否有血管阻塞之問題。 數值越小表阻塞的程度越厲害。

[筆記] 用英文學德文 Learning German with English

因為語系相近的緣故,相對於使用中文學德文,若有相當的英文基礎,其實使用英文來學習德文會更加的事半功倍。尤其是在文法上,因為文法較為相似,使用互相比較的方法,比較好記憶跟運用,雖然德文的Case(格)比英文多,不是所有的英文都可以對上,但還是比用中文學習要來得簡單。

在使用的字母上,德文字母多了Ä, Ö, Ü, ß,在無法打出德文字母的情況下(像是網址),可用AE, OE, UE, ss代表。(德文輸入可以參考這篇[德文筆記] 德文字母怎麼打?

拼字(英-->德):
c-->k

發音(英-->德):
h--> ch
sh-->sch
tion也是常見字尾,但是念法不同

最近在線上找尋相關的資料時,發現有部落格提到了一本書,書名為「由英文學德文」,是一本翻譯著作,但使用原文(德文)的書名無法找到原書,至於中文版的書籍也是1980年發行,年代相當久遠,大家有興趣可以去北市圖借來翻翻。

He also periodically works with inventors and businesses who have mechanical and electrical innovations. Between 2003 and 2007, Gene wrote a monthly column for Patent World and served on the Patent World editorial board. He has also previously taught a variety of intellectual property courses at the law school level, including patent law, patent claim drafting, patent prosecution, copyright law, trademark law and introduction to intellectual property. Between 1998 and 2008 Gene taught at Syracuse University College of Law, Temple
University School of Law, The University of Toledo College of Law, Franklin Pierce Law Center and Whittier Law School. Since 2010 he has been an Adjunct Professor at John Marshall Law School where he teaches a course on Patent Rules and Practice. Gene is admitted to practice law in New Hampshire, is a Registered Patent Attorney licensed to practice before the United States Patent Office and is also admitted to practice before the United States Court of Appeals for the Federal Circuit.

Scott Burt

Senior Vice President and Chief Intellectual Officer Conversant
Scott leads Conversant’s legal professionals, including the corporate counsel and secretary functions, ligation, and patent prosecution. He also heads the Company’s public policy initiatives, and in 2013 spearheaded the development of its Patent Licensing Principles document. He actively participates in patent licensing negotiations and patent acquisitions. Scott joined Conversant in 2012 and was named to his current role in 2014.

Scott is a 21-year veteran of Jones Day, one of the top IP firms in the United States and globally. At Jones Day, he led a diverse IP and technology practice focused on complex litigation, IP counseling, and IP transactions.  In the patent enforcement and litigation area, Scott’s practice emphasized patent analysis, global litigation and dispute resolution for clients in electronics, software, communications and other industries.

Scott holds a Juris Doctor, Order of St. Ives, from the University of Denver, and a BA in Mathematics with Computer Science from the University of Colorado.  He is a member of Illinois, Texas and Colorado bars, is widely published in professional journals and is a frequent speaker at legal and other conferences.  Scott belongs to the American Intellectual Property Law Association, Licensing Executives Society, and the Intellectual Property Owners Association, and was honored as an Illinois Super Lawyer – Intellectual Property Litigation, in 2005 and 2006.

Phil Hartstein

President and CEO of Finjan Holdings Inc.
Phil Hartstein is President and CEO of Finjan Holdings Inc. (NASDAQ: FNJN).  He oversees the direction and management of current assets and future investments while coordinating with the executive management team and Board to execute on the Company’s vision.

Mr. Hartstein has worked in a number of technology and intellectual property related roles for over a decade.  He started with a boutique IP law firm, worked as an in-house portfolio manager for a VC funded startup, spent time in IP consulting and IP brokerage firms, and prior to joining Finjan, spent four years bringing both private and public market capital, expertise, and credibility in licensing and enforcing patent rights on behalf of owners.

Mr. Hartstein holds a BS in industrial technology from California Polytechnic, San Luis Obispo.  He is a regular speaker on IP and policy related issues, participant in industry and trade organizations, and is a named inventor and patent holder with more than two dozen pending and issued patents across a number of disciplines.

Demand letter vs. Notice letter
Demand letter通常只是想要要錢(financial demand), they are badly copied, and usually lacking of further information of the patent which they claimed you infringe.
while Notice letter其實是不大一樣的,當一般的IP擁有者在主張自己的權力時,信件中會更為軟性的提出建議、討論,遠先於提出金錢要求

[德文筆記] 德文古典字體Fraktur / Kurrent

德文書寫體&印刷體
自16世紀以來直到第二次世界大戰,德文的書寫體和印刷體總是和其他的歐系語言不大相同,「Fraktur」這個專有詞用來指稱印刷體德文,字母之間是個個分離的;而手寫的書寫體,每個字母則是都相互連結,稱作「Kurrent」,Kurrent這個字本身有流動(running)的意思。

長期以來Fraktur幾乎沒有什麼變化,但Kurrent則是發展出幾種不一樣的變體。現在許多老德國人所使用的其實是Sütterlinschrift,又稱Sütterlin,是由Ludwig Sütterlin (1865–1917)所設計,雖然Sütterlin現在也被用來泛稱各種傳統的德文書寫體,但僅有Ludwig Sütterlin本人的版本有在1935-1941年間在學校被正式教授,事實上,也有人認為這樣的稱法並不合適,畢竟書寫體早在Sütterlin出生之前就已經存在,他的版本雖是最有名的,但亦只是其中之一。

在第三帝國(註)的早期,納粹非常重視Fraktur跟Kurrent,認為這些是喚起德文獨特性的象徵,但隨著德國開始征服鄰國,Fraktur及Kurrent這樣的書寫系統便成為了溝通上的障礙,後來便漸漸被拉丁字母取代。

[筆記] Biogen Unchained (HBR)

內容破題點出Biogen原本的經營模式相較創立年1978的狀態,自1994年因為Avonex的推出而有重大改變,從授權其他藥廠製造,轉為自行掌權,掌握製造跟相關供應鏈。

藉由創造以合作關係的為基礎的供應鏈,Biogem進一步細分相關項目,藉以切割自主操作和外包的分工,檢視主要四項目:
  • bulk manufacturing, 
  • formulation, 
  • packaging, 
  • warehousing and distribution
Bulk manufacturing部分,由於可延續當初臨床試驗的製造產能,並確定可擴大(產能),在資源有限的情況下,選擇將此留下,將其他部分外包,但仍需尋求規模適中的合作對象,又須大到具有足夠能量可配合快速成長,但又要彈性(小)到能夠給予Biogen產品優先順位

Formulation部分,考慮到需要具有冷凍乾燥及低溫儲藏的能力,選擇位於Ohio,並有和大型藥廠合作經驗的Ben Venue Laboratories

Packaging部分則分派給靠近Phildelphia的一間小型創新公司---Packaging Coordinators

而最後的warehousing & distribution部分Biogen則選擇和Amgen合作,由於其擁有一座位於Louisville, Kentucky中心的派送中心,且產能過剩,Amgen很樂意提供Biogen友善的價格,使用其靠近機場和UPS運送點的冷藏儲存空間

[整理註] 以上三個州彼此相鄰,大約位於方圓750mile(約相當1200km)以內

對此供應鏈,Biogen採行緊密的控制,除了派駐自己的員工,亦建置了新的資訊分享管理系統,並針對每個環節制定嚴格的績效表現,致力打造世界級的供應網絡,無論如何都要達到無延遲的訂單供貨要求。

Robert Hamm,現任營運副總、亦是launch team的一員提到最糟糕的情況就是產品缺貨(“the worst thing that could happen” would be to run out of the product)藥品缺貨的情況不僅是對於使用的病患造成影響,更會巨幅影響Biogen的利潤,由於產品的高單價---月開銷1000美金,相較於承載儲貨的成本就顯得微不足道了。

公司屏息以待FDA的最終核准,透過詳細縝密的配送規劃,在1996年5月17日星期五早上11點,Avonex一通過,第一批藥物在35小時內就送到了藥局架上,同時也成了製藥產業的新紀錄,而藥物在週一早上就可開始調劑、施用。

Avonex上市六個月內就打敗了三年前進入市場,用於治療MS的market leader---Betaseron,贏得市場6成以上的新處方。

[註]Biogen採取了巨大的商業模式轉變,雖然提到其「不」具有足夠的錢與時間進行全然的自主製造、將產品推上市場,但本篇並無法看出Biogen在一路發展的十幾年來,其公司整體規模與能量提昇的情況,故「新興」生技公司在試圖模仿尋求合作夥伴並進行管理藉以取代授權的模式,不見得可達成,仍須進行多方評估。另外合作對象除了相關能力之外,貌似還要有地理區位的優勢,方可緊密配合,公司本身亦要有相當規模,在合作契約洽談時才具有足夠的bargain power進行利己的內容談判,並達成緊密控制的目標。CM的分權,可能有利於整體技術內容的保全,但是管理成本增加,非人人玩得起、玩得好。

第一次看到是在Facebook上面的粉絲專頁,而不久前推出了網頁版!

網頁目前延續粉絲專業上的德文心智圖外,還有籌備中的線上課程,最終目標是提供多面向的服務,像是你到了德國讀書/工作所需要的支援,舉例:找房、學德文、交朋友usw

雖然頁面有一小部分使用英文,但大部分還是德文為主,如果是非常初學者,可能會很吃力,線上課程部分之後如果正式推出,會再補充上來,屆時應該會比較適合初學者(A1)

Many people don’t appreciate the fact that English nouns have no gender until they come upon another language which does. French and Spanish nouns have both masculine and feminine gender, which is bad enough for most learners, but German learners have to put up with yet another one: the neuter.
許多人一點都不感念英文名詞沒有陰陽性之分,直到他們開始學習其他有性別的語言,像是德語、法語、西班牙語等等。法語、西語分為陽性(masculine)、陰性(feminine),這就已經夠糟了,但是德語學習者還要加上中性(neuter)。

Admittedly, it’s not as bad as Polish which has 5 genders, or Swahili, which sports a whopping 18 noun classes, but for most of us mere mortals, putting up with der, die, das on a daily basis is frustrating enough.
好啦!這可能沒有波蘭語的5種來得糟糕,或是斯瓦希裡語高達18種的語態來得令人崩潰,但是對於我們這些一般人來說,der, die, das就已經足夠讓我們暈頭轉向了!

For example, it seems obvious that the word Bruder (brother) is masculine whereas Schwester (sister) is feminine. But why — in the name of the three-legged Goat of Grammar! — why is Mädchen (girl) neuter?
舉例來說,Bruder (brother 兄弟)這個字明顯是個陽性字,而Schwester (sister 姊妹)則是陰性字,但是為什麼!為什麼Mädchen (girl 女孩)這個字卻是中性呢?

Before we now venture off into gender studies, I want to remind everyone of the distinction between biological gender and grammatical gender. In English, they share the same term, which makes for a lot of name-calling and holy wars in the name of “gender equality”. In German, the former is called Geschlecht, while the latter is called Genus. While there are some correlations, these are two separate phenomena.
在我們開始進入這個gender studies之前,我想要提醒大家所謂的「生理性別」和「文法性別」的不同。在英文裡面,我們使用同樣的詞來解釋,所以就會出現一大堆的「性別平等」問題。在德文裡,前者稱作Geschlecht,後者稱作Genus,兩者雖有關連但是被視為兩種不同的東西。

After playing around with this tool for a while it seems that it could be a helpful tool for German learners. Unfortunately, it only works if you’re writing emails in your browser via Gmail, Yahoomail and Outlook.
試用一陣子之後,看起來這的確是個可以幫助德語學習者的好工具,不幸的是它只能用在瀏覽器底下的Email寫作,像是你的Gmail, Yahoo Mail或是Outlook

According to the developers’ website, a downloadable version for Apple Mail and Outlook (desktop) is coming soon, but I think it could also be great to extend this tool’s functionality beyond email writing to Social Media.
根據開發者網站的訊息,可用在Apple Mail跟Outlook(桌上型電腦)的版本將會在近期推出,但是我想如果可以把這個功能延展到社群網站的話,一定更棒!

Many language learners are using Twitter or Facebook these days to engage in practice and discussion, so this tool might come in handy while posting updates or comments.
現在有許多語言學習者都會透過Twitter或是Facebook來練習和討論,所以這樣的工具或許對於大家po更新或是貼文會來得更有幫助。

[筆記] 學測後的建議

當年考完老師發給大家的一些建議讓大家可以在短短的寒假喘口氣並繼續衝刺。
有鑑於現在又是剛考完學測的季節,供大家參考看看囉~

以下正文開始:

學科能力測驗後的一些建議


  1. 為什麼要預估學科能力測驗成績:
    1. 掌握自己作答狀況,可以核對成績單上計分是否有誤
    2. 用預估的級分了解樂觀的看、保守的看,有機會甄選哪些校系
    3. 從學測成績、準備學測的狀況,和學姊錄取情況比較(老師當年有用我們學校本身成績做了一個資料庫,統計分析學測分數跟指考分數的關連性,但在這裡不適用大家的情況),重新評估自己的實力,訂定合理的目標。進而決定用多少力氣準備甄選入學
  2. 寒假可以為甄選入學做什麼?
    1. 設定10個左右的目標校系,有樂觀目標,有保守目標
    2. 針對目標校系的共同特質,準備自傳、讀書計畫與其他備審資料
    3. 進一步了解目標校系,包括課程、發展,也包括指定項目甄試內容
    4. 針對指定項目甄試內容,進行課外閱讀與考試準備
  3. 寒假可以為考試分發做什麼?
    1. 設定合理的考試分發校系目標,查看考試分發簡章,去了解這些校系考試分發的科目與加重計分科目
    2. 評估自己各考科的程度實力,可能進步的幅度
    3. 計畫第二學期各科在時間分配上的比重與複習的優先順序
  4. 備審資料準備的一些建議:
    1. 注意事項先看好:大學網站+該系網站+簡章規則必看!
    2. 與其大費周章包裝,不如多花心思在內容,凸顯優點
    3. 面試時,教授會從妳的資料提問,在資料準備過程可以預先思考可能會引起進一步注意的內容與問題
    4. 多參考各校輔導室網站與學校輔導室內學姊的資料
  5. 寒假讀哪些課外書籍?到哪裡找書?哪裡買書?
    1. 到圖書館找相關的雜誌,翻閱過期雜誌目錄,影印有用的文章
    2. 到書店或圖書館找介於專業與通俗間的相關書籍,如:科普類的書籍,相關專業的入門書籍
    3. 近年的熱門暢銷書,如:「達文西密碼」、「恐懼之邦」(這是當年的資料,請與時俱進XD)
    4. 各類書籍完整,賣場規劃舒適,誠品信義店是首選;考慮荷包要買便宜書,走一趟師大路、浦城街找「水準書店」、「政大書城」吧!
原本老師的建議還有附上計分表,但我想大家對過報紙上的答案應該也是可以直接把剪報或是補習班的詳解留下就可以了
(其實我不是很喜歡用報紙對,因為看到答案會很干擾,第一次對的時候要記得把正解遮起來會比較準)

簡單來說,重點就在於評估自己這次的表現足不足以達到現階段的目標!
如果之後的進步幅度有限,像是理想校系指考項目的加重計分科目不拿手,或許就應該多花一點心力準備推甄/申請。
最後,個人小小的心得是不要去甄選or申請沒有很想去的學系!
雖然老師在建議當中提到保守跟樂觀這兩種目標,但保守並不是說因為一定會上所以去申請的目標,而應該是想去而且在能力範圍內的學系。
不論是甄選或是申請,繁複的流程絕對不是很輕鬆就可以搞定的,最後不管上或沒上,不想去的學校會讓你徒增困擾! 所以放自己一馬吧! 不要因為大家說或是爸媽說或是老師說或是自己的不安心,去寫一個很安全但是沒興趣的系,假設真的上了,只會讓你念指考不專心而已,還要花時間想要不要放棄,真的去念了,也不會開心的。

[德文筆記] Ich habe ein halbes Jahr in Deutschland studiert 我在德國讀了半年書

Ich habe ein halbes Jahr in Deutschland studiert, aber meine Kurse wurden in Englisch unterrichtet.
Daher kann ich nur ein bisschen Deutsch sprechen.

I have studied in Germany for half year, but my course were taught in English.
Therefore, I can only speak a little German.

daher: hence, therefore

我在德國讀了半年書,
但是我的課程都使用英文教授,
所以我還是只能說一點點德語。

The difference between multinational and international companies

I personally prefer Andrew Hines' definition, which are
  • International companies are importers and exporters, they have no investment outside of their home country.
  • Multinational companies have investment in other countries, but do not have coordinated product offerings in each country. More focused on adapting their products and service to each individual local market.
  • Global companies have invested and are present in many countries. They market their products through the use of the same coordinated image/brand in all markets. Generally one corporate office that is responsible for global strategy. Emphasis on volume, cost management and efficiency.
  • Transnational companies are much more complex organizations. They have invested in foreign operations, have a central corporate facility but give decision-making, R&D and marketing powers to each individual foreign market.

很多人都說,學德文不容易,甚至還有「英文30小時,法文30天,德文30年」的說法存在,這樣的說法或許跨大,卻不難想見學習德文肯定要付出更多心力才能學的通透。其實德文文法雖然複雜卻很有邏輯性,只要花心思學,反而更容易學得好。只要過了文法這一關,相信其他部分的學習,都會猶如倒吃甘蔗般地漸入佳境。
